Pets are now fully part of the family, but their presence in a building can affect the serenity of residents. That is why the owners should know how to manage, so that annoying little as possible, to avoid quarrels and fights. The holding of an animal can be integrated in the abstract the case provided for in art. 844 cc, since, broadly construed, is likely to be applied in all cases of entries which causes a current intolerable situation. Therefore, in the absence of a regulation prohibiting the individual contract to keep animals in his exclusive property, the legality of that detention must be determined by the court according to the criteria governing the evaluation of the tolerability of entries (April 10, 1990 Court of Piacenza, Arch Loc No 231 in 1990, 287).

Se neppure il suo intervento sortisce effetto, non resta che ricorrere all’autorità giudiziaria.
Una decisione del Tribunale Naples calendar (October 25, 1990 order, Ragosta and others against Miranda and Carlo, in loc Arch. and cond. 1990, 737) states: "Where a contract-house regulations prohibit any pets that may disturb to condominiums, the court found these disorders, may order, with an interim measure, the removal of animals from the apartments they are kept. "Also, the Court of Naples has confirmed (order of 8 March 1994, loc Arch. And cond. 1994, 337) that the court, by injunction, may order public bodies to remove nuisance animals from the apartment building, with absolute prohibition on return.
