Changes to the rules of the condominium buildings
Article 1.
1. Article 1117 of the Civil Code reads as follows:
'Art 1117. - (Parts of the building) - The subject of joint ownership of the owners of individual units.
Estate building, if it is not otherwise entitled, under penalty of nullity that should indicate further intended, even if entitled to periodic enjoyment:
1) all parts of the building you need to use common, such as the soil on which it stands the building, foundations, main walls, roofs and flat roofs, stairs, entry doors, vestibules, the hallways, porches, yards and facades;

Article 2.
1. After Article 1117 of the Civil Code shall be inserted the following:
'Art 1117-ca. - (Scopes). - The provisions of this chapter shall apply, mutatis mutandis, in all cases where more housing units or more buildings or more residential units to condominiums or buildings have common areas in accordance with Article 1117.

Article 3.
1. Article 1118 of the Civil Code reads as follows:
'Art 1118. - (Rights of participants on the common parts). - The right of each condominium the common parts, unless the license provides otherwise, is proportional to the value of one property that belongs to them, taking into account the intended use structural and functional.
The condominium can not renounce its right to the common parts or be freed from the bond of solidarity with the third. Article 4.
1. Article 1119 of the Civil Code reads as follows:

Article 5.
1. Article 1120 of the Civil Code, the first paragraph is replaced by the following:

Article 6.
1. Article 1122 of the Civil Code reads as follows:
'Art 1122. - (Works on shares of ownership or occupancy). - In the unity of its real estate properties or common areas where it has reserved the ownership or use individually, each owner can not perform work or change or alter the intended use indicated by the title, although permitted by the rules of construction, if the damage resulting therefrom to the common areas or individual, or significant reduction of enjoyment or value of them, or undermine the stability, security or decoration of the building.

Section 7.
1. After Article 1122 of the Civil Code shall be inserted the following:

La semplice esibizione della documentazione amministrativa relativa all’osservanza delle normative di sicurezza non è di ostacolo all’accesso. L’amministratore esegue l’accesso alle parti comuni con un tecnico nominato d’accordo con il richiedente ed esegue l’accesso alle unità immobiliari di proprietà individuale con un tecnico nominato di comune accordo tra il richiedente e l’interpellato. Il tecnico nominato, al termine dell’accesso, consegna una sintetica relazione al richiedente ed all’amministratore, il quale la tiene a disposizione di chiunque vi abbia interesse. Article 8.
1. Article 1124 of the Civil Code shall be amended as follows:

Art. 9.
1. L’articolo 1129 del codice civile è sostituito dal seguente:
«Art. 1129. – (Nomina, revoca ed obblighi dell’amministratore). – Quando i condomini sono più di quattro, se l’assemblea non vi provvede, la nomina di un amministratore è fatta dall’autorità giudiziaria su ricorso di uno o più condomini.
Contestualmente all’accettazione della nomina e ad ogni rinnovo dell’incarico, l’amministratore dichiara all’assemblea di aver assolto agli oneri di cui all’articolo 71 delle disposizioni per l’attuazione del presente codice e comunica i propri dati anagrafici e professionali, il codice fiscale, o, se si tratta di società, anche la sede legale e la denominazione, nonché l’ubicazione, la denominazione e il codice fiscale degli altri condominii eventualmente amministrati, il locale ove si trovano i registri di cui ai numeri 6) e 7) dell’articolo 1130, nonché i giorni e le ore in cui ogni interessato, previa richiesta all’amministratore, può prenderne gratuitamente visione e ottenere, previo rimborso della spesa, copy signed by him. Article 10.
1. Article 1130 of the Civil Code reads as follows:

1) perform the deliberations of the Assembly, convened annually to approve the condominium statements referred to in Article 1130-bis and treat compliance with building regulations;

3) collect contributions and disburse the expenses necessary for the maintenance of the common parts of the building and operation services;
4 ) carry out acts relating to the conservative parts of the building;
5) perform tax obligations;

Article 11.
1. Dopo l’articolo 1130 del codice civile è inserito il seguente:
«Art. 1130-bis. – (Rendiconto condominiale). – Il rendiconto condominiale è redatto con criteri di competenza; le voci di entrata e di uscita ed ogni altro dato inerente alla situazione patrimoniale del condominio, ai fondi disponibili ed alle eventuali riserve devono essere espressi in modo da consentire l’immediata verifica. Si compone di un registro di contabilità, di un riepilogo finanziario, nonché di una nota esplicativa della gestione con l’indicazione anche dei rapporti in corso e delle questioni pendenti. L’assemblea condominiale può, in qualsiasi momento o per più annualità specificamente identificate, nominare an auditor who verifies the accounts of the building. Article 12.
1. Article 1131 of the Civil Code shall be amended as follows:

Art. 13.
1. L’articolo 1134 del codice civile è sostituito dal seguente:
«Art. 1134. – (Gestione di iniziativa individuale). – Il condomino che ha assunto la gestione delle parti comuni senza autorizzazione dell’amministratore o dell’assemblea non ha diritto al rimborso, salvo che si tratti di spesa urgente.
Se una deliberazione adottata dall’assemblea non viene eseguita, ciascun condomino può diffidare l’amministratore o, in mancanza, il condomino eventualmente incaricato. Decorsi inutilmente trenta giorni dalla diffida, egli può intraprendere l’esecuzione della deliberazione ineseguita. Se entro tale termine l’amministratore si oppone per iscritto all’iniziativa del condomino, questi può chiedere l’autorizzazione del tribunale che, sentite le parti, provvede in via d’urgenza, disponendo anche in ordine alle modalità di esecuzione ed alle relative spese».
2. All’articolo 1135 del codice civile è aggiunto, in fine, il seguente comma: «L’assemblea può autorizzare l’amministratore a collaborare a progetti territoriali promossi dalle istituzioni locali per migliorare la qualità della vita e la sicurezza della zona in cui il condominio è ubicato anche mediante la preventiva raccolta di dati relativi ai bisogni e alle esigenze di lavoro di residenti e abitanti».
Art. 14.
1. L’articolo 1136 del codice civile è sostituito dal seguente:
«Art. 1136. – (Costituzione dell’assemblea e validità delle deliberazioni). – L’assemblea in prima convocazione è regolarmente costituita con l’intervento di tanti condomini che rappresentino i due terzi del valore dell’intero edificio e la maggioranza dei partecipanti al condominio.
Sono valide le deliberazioni approvate con un numero di voti che rappresenti la maggioranza degli intervenuti e almeno la metà del valore dell’edificio.
Se l’assemblea in prima convocazione non può deliberare per mancanza di numero legale, l’assemblea in seconda convocazione delibera in un giorno successivo a quello della prima e, in ogni caso, non oltre dieci giorni dalla medesima. La deliberazione è valida se approvata dalla maggioranza degli intervenuti con un numero di voti che rappresenti almeno un terzo del valore dell’edificio.

Art. 15.

Article 16.
1. Article 1138 of the Civil Code, the third paragraph reads as follows:

Article 17.
1. Article 2643 of the Civil Code is added at the end, the following number:

Article 18.

Article 19.

Article 11.

Article 12.
1. Article 1131 of the Civil Code shall be amended as follows:

Art. 13.
1. L’articolo 1134 del codice civile è sostituito dal seguente:
«Art. 1134. – (Gestione di iniziativa individuale). – Il condomino che ha assunto la gestione delle parti comuni senza autorizzazione dell’amministratore o dell’assemblea non ha diritto al rimborso, salvo che si tratti di spesa urgente.
Se una deliberazione adottata dall’assemblea non viene eseguita, ciascun condomino può diffidare l’amministratore o, in mancanza, il condomino eventualmente incaricato. Decorsi inutilmente trenta giorni dalla diffida, egli può intraprendere l’esecuzione della deliberazione ineseguita. 2. All’articolo 1135 del codice civile è aggiunto, in fine, il seguente comma: «L’assemblea può autorizzare l’amministratore a collaborare a progetti territoriali promossi dalle istituzioni locali per migliorare la qualità della vita e la sicurezza della zona in cui il condominio è ubicato anche mediante la preventiva raccolta di dati relativi ai bisogni e alle esigenze di lavoro di residenti e abitanti».
Art. 14.
1. L’articolo 1136 del codice civile è sostituito dal seguente:
«Art. 1136. – (Costituzione dell’assemblea e validità delle deliberazioni). – L’assemblea in prima convocazione è regolarmente costituita con l’intervento di tanti condomini che rappresentino i due terzi del valore dell’intero edificio e la maggioranza dei partecipanti al condominio.
Sono valide le deliberazioni approvate con un numero di voti che rappresenti la maggioranza degli intervenuti e almeno la metà del valore dell’edificio.
Se l’assemblea in prima convocazione non può deliberare per mancanza di numero legale, l’assemblea in seconda convocazione delibera in un giorno successivo a quello della prima e, in ogni caso, non oltre dieci giorni dalla medesima. La deliberazione è valida se approvata dalla maggioranza degli intervenuti con un numero di voti che rappresenti almeno un terzo del valore dell’edificio.

Art. 15.

Article 16.
